Grantor in Real Estate
The person who conveys real property (in U.S. law) to another by deed (in U.S. law). The grantor is often designated in the deed as the “party of the first part.” The grantor must be of legal age and of sound mind. If the grantor is a corporation, execution (in U.S. law) of the deed must be duly authorized by the directors or stockholders as required by state law. If the grantor is a trustee or executor, the trust instrument or will (in U.S. law) must be examined to determine whether the grantor has power to convey real estate. The marital status of the grantor is usually stated in the deed for example, bachelor, widow, spinster (or unmarried), married, or divorced and not remarried. Whether the grantor’s spouse must join in the deed depends upon the law of the state where the land is situated. See also grantee (in U.S. law).
