Practical Information

Note: Some of this information was last updated in 1982

The transfer of one person’s rights to another. Assignments are made (a) by the act of the parties, as in the case of a tenant assigning his or her lease to another; or (b) by operation of law, as in the case of death or bankruptcy. The party transferring a right is the assignor; the party to whom the rights are transferred is the assignee. An assignment need not be in any particular form. It may be oral or written, unless it involves a contract required by the statute of frauds (in U.S. law) to be in writing. It may be a formal document or an endorsement on the contract signed by the assignor. An assignment does not require any consideration, but it must effect an immediate transfer to a specific assignee.
