Plain-English Law
Power Of Attorney as defined by Nolo’s Encyclopedia of Everyday Law (p. 437-455):
A document that gives another person (called the attorney-infact or agent) legal authority to act on behalf of the person who makes the document, called the principal.
Practical Information
Note: Some of this information was last updated in 1982
A written instrument in which the principal (the person giving the power of attorney) authorizes another to act for him or her. The instrument may be a blanket authorization, as in the case of a person embarking on an extended voyage. More often it authorizes the agent to represent the principal in one specific transaction, as the closing of a real estate deal; or to do a particular act continuously, as the signing of checks or the collecting of money on behalf of the principal or the authority to institute suit or collect dividends.
The appointed person is commonly called an attorney in fact. The power of attorney may be revoked at the will of the principal, unless it was given to the agent for a consideration. See also proxy (in U.S. law) .
