Certified Check Definition
A check which has been recognized by the proper officer as a valid appropriation of the amount of money therein specified to the person therein named, and which bears upon itself the evidence of such recognition. Certification of a check is usually accomplished by writing the name of the officer authorized to bind the bank in that manner across the face of the check. See Check. Sewell, Bank.

Practical Information

A check (in U.S. law) that has been guaranteed by the bank both as to signature and amount. Either the maker of a check or the holder can present the check for certification at the bank on which the check is drawn. The bank examines the drawer’s account, charges the account immediately for the amount of the check, and marks the check “accepted” or “certified.” The check then ceases to be an order on the bank and becomes an obligation of the bank. Hence, certification of a check makes it equivalent to cash. Certified checks are used principally in real estate and securities transactions in which cash payment is required. When drawers (in U.S. law) have checks certified, they accept the bank as their debtor. A drawer is not liable in case of insolvency of the bank before payment. Drawers of a certified check cannot stop payment on it. They should redeposit the check if it is still in their possession and not destroy it. If a bank certifies a check by mistake, it may withdraw the certification if it acts promptly, provided the holder has lost no right.
