Practical Information

One who enters into a contract of sale (in U.S. law) and agrees to sell real property (in U.S. law) to another (vendee (in U.S. law)). Every contract of sale must have a vendor or “seller.” The vendor may be an individual, a partnership (in U.S. law), a corporation (in U.S. law), or a representative. The individual may be either an adult or a minor, or the person may enter into the contract in a representative capacity. If the vendor is a minor or an incompetent, the contract of sale should indicate that fact and give the name of the individual’s guardian, together with the date of the court order under which he or she was appointed. If the vendee is a representative, such as an agent or an executor, the contract should set forth the source of the representative’s authority.
