Executed Estate Definition
An estate whereby a present interest passes to and resides in the tenant, not dependent upon any subsequent circumstances or contingency. They are more commonly called “estates in possession.” 2 Sharswood, Bl. Comm. 162. ‘ An estate where there is vested in the grantee a present and immediate right of present or future enjoyment. An estate which confers a present right of present enjoyment. When the right of enjojonent in possession is to arise at a future period, only the estate is executed; that is, it is merely vested in point of interest. Where the right of immediate enjoyment is annexed to the estate, then, only, is the estate vested in possession. 1 Prest. Est. 62; Feame, Cont.
