The care and control of infants as determined by a court. The court’s basic consideration when it gives orders and directions concerning the custody of children is the welfare of the particular child. Courts will often consult a child to find out with which parent the child prefers to live. A child may be taken away from a parent or legal guardian, a charitable agency or welfare commissioner, or even from one to whom the court itself had granted custody.
