Patent Litigation

Patent Litigation in the United States

Sources of Funding for Patent Litigation

One of the problems that inventors whose patents are infringed must consider is how to fund patent litigation. There are some organizations that fund patent litigation. While some are reputable, are trying to do an honest job, and have happy clients, others have a questionable reputation and urge caution. Inventors should talk with other inventors who have had experience with an organization before doing business with it. Inventors should be aware that the nature of the contracts some of these organizations enter into with inventors is such that it is difficult for an inventor, to pursue other alternatives if things go bad, or event to describe their experiences. It is advisable to read carefully between the lines in what people say and get input from knowledgeable people before you sign a major contract.

Some organizations are the following:

Enpat, Inc (Melbourne, FL32901). Enpat reaches agreements with inventors whereby it takes over the management and licensing of the invention against infringers.

Intellectual Property Insurance Services (Louisville, KY 40223). Sells both patent insurance which funds litigation should you be infringed, and funds litigation once infringed.
Patent Enforcement Fund (Southport, CT, 06490). Lexington and AIG provide patent insurance against a companies products infringing the patents of others.
