Hazardous Chemical in Environmental Law

A chemical regulated by the Occupational Health and Safety Administration through the Hazard Communication Standard. The requirements set forth in the standard were established to protect workers in the workplace.

The person responsible for determining whether a chemical is a hazardous chemical is the manufacturer or importer of the chemical, and the process is called a hazard determination. To make a determination, the manufacturer or importer must identify and consider all available scientific evidence. If at least one credible study reveals a health or physical risk, it is sufficient evidence to label the chemical hazardous.
