Disparagement Definition
In old English law. An injury by union or comparison with some person or thing of inferior rank or excellence. Marriage without disparagement was marriage to one of suitable rank and character. 2 Sharswood, Bl. Comm. 70 ; Co. Litt. 82b. The guardian in chivalry had the right of disposing of his infant ward in matrimony; and provided he tendered a marriage without disparagement or inequality, if the infant refused, he was obliged to pay a valor maritagii to the guardian. Disparagare, to connect in an unequal marriage. Spelman. Disparagatio, disparagement. Used in Magna Charta (9 Hen. III.) c. 6. Disparagation, disparagement. Kelham. Disparage, to marry unequally.
