A payment reserved by the grantor of a patent, lease of a mine or similar right, and payable proportionately to the use made of the right by the grantee. 1 Exch. Div. 310. A payment reserved by the patentee of an article on giving a license, or by the author of a book in contracting for its publication or sale, proportionate to the sales under such license or contract.
