If two or more persons hold an estate by separate and distinct titles, with unity of possession only, the estate is called tenancy in common. The tenants in common may acquire their title (in U.S. law) at different times, from different sources, and have different degrees of interest in the estate, but their right of possession is common. Upon the death of one of the tenants in common, his or her interest passes to heirs and legatees, and not to the other tenants in common.
