A warning in writing to the opposing counsel concerning a particular action that an attorney wants the court (in U.S. law) to take in a pending case.
The notice of motion states the papers and proceedings upon which the motion will be brought and also the grounds of the motion. The supporting papers usually include an affidavit that is attached to the notice of motion.
Return day of motion
All notices of motion give the date the attorney will move the court for entry of the desired order. This date is the return day of the motion; the motion is returnable on that day. The practice rules provide that the notice shall be served on opposing counsel a specified number of days, or a reasonable time, before the return day of the motion. Some jurisdictions that do not have special terms of courts for motions set aside certain days in the month as motion day, on which days all motions are returnable.
