The legend or clause that relates the circumstances surrounding the signing of an instrument. It usually precedes the signature of the attesting witnesses. For example, if Robert Niles were testator, the attestation clause in his will might read: “Signed, sealed, published and declared by Robert Niles, the above named testator, as and for his Last Will and Testament in our presence, and we, at his request, in his presence and in the presence of each other, have hereunto subscribed our names as witnesses this 5th day of September in the year 19 ” The wording of an attestation clause may be simply: “In the presence of”.
