The Franchise Tax Board administers the taxes imposed under the Personal Income Tax Law and the Corporation Tax Law. Existing law authorizes persons that are required to withhold taxes from recipients of income to require the recipients of the income to provide that person with the recipient’s name and address. This bill requires the recipient of income to also provide the person paying the income with the payee’s Social Security number or other taxpayer identification number if requested by the person paying the income. A.B. 1925
Requires a state governmental licensing entity, as defined, issuing professional or occupational licenses, certificates, registrations, or permits to provide to the Franchise Tax Board the name and Social Security number or federal taxpayer identification number of each individual licensee of that entity. The bill requires the Franchise Tax Board, if an individual licensee fails to pay taxes for which a notice of state tax lien has been recorded, to send a notice of suspension to the applicable state governmental licensing entity and to the licensee. Except as specified, this  bill prohibits a retail business or landlord from soliciting, requiring, or using an individual’s Social Security number for any purpose unless that number is necessary for that business’s normal course of business and there is a specific use for that number for which no other number may be used. Existing law requires an abstract of a judgment or decree requiring the payment of money to contain, among other things, the Social Security number and driver’s license number of the judgment debtor if they are known to the judgment creditor, as specified. Existing law also requires an abstract of a judgment ordering a party to pay spousal, child, or family support to contain, among other things, the Social Security number, birth date, and driver’s license number of the party who is ordered to pay support, as specified. Directs government bodies to make reasonable efforts to exclude social security numbers from public recordsby excluding Social Security numbers from documents that may be readily observed by the public, by giving individuals the option to not submit a Social Security number to the government body, and by removing a Social Security number from a public record following a request by the individual. The bill provides that an individual has the right to request that a government body redact the individual’s Social Security number from a public record available to the general public or on a web site available to the general public. The bill requires each request to specify the Social Security number to be redacted and the location of the document thatcontains the number. The bill directs the citizens’ aide to receive all requests and forward each request to the lawful custodian of the public record for redaction. The bill provides that the lawful custodian of the public record has no duty to inquire beyond the request to verify the identity of the individual requesting the redaction. The bill does not limit the duties of a county recorder under Code §331.606A. The bill provides that any person who requests a redaction of a Social Security number without proper authority to do so is guilty of a simple misdemeanor.
