Makes a heading change to Title 44, Chapter 9, Article 17, from confidentiality of Social Security numbers to confidentiality of personal identifying information. Stipulates that recorded documents and records that are made available on a public Web site must not contain more than five of an individual’s Social Security numbers. Prohibits the documents/records from containing the following personal identifying information: 1) Credit, charge or debit card numbers; 2) Retirement account numbers; and 3) Savings, checking or securities entitlement account numbers. Permits only the attorney general, county attorney, or both individuals, to file a legal action for a violation of the provisions of this bill. Assesses a $500 civil penalty for violations of the provisions. Makes an exception for the person or entity that transmits the document for recording purposes only. Exempts a county agency from civil liability for any action relating to recorded information.

Lists exceptions, including uses required, permitted, or authorized by state or federal law. Allows a preexisting nonconforming use of a SSN to continue if all of the following conditions are met: The use of the SSN is continuous; and the person or entity provides the individual with an annual disclosure that informs the individual that he or she has the right to stop the nonconforming use of his or her SSN. Requires the person or entity to implement a written request by an individual to stop the nonconforming use within 30 days after the receipt of the request. Prohibits the person or entity from denying services to an individual because the individual makes such a written request. Includes a SSN in financial data that may not be inspected as part of a public record, unless disclosure is required, permitted, or authorized by state or federal law.

Generally under current law, a register of deeds is required to record in his or her office any document that is authorized by law to be so recorded. In addition, a register of deeds is required under current law to make and deliver on demand, to any person who pays the required fees, a copy of any record, paper, or file in the register’s office.  Under this bill, a register of deeds may not record any instrument offered for recording if the instrument contains more than the last four characters of the Social Security number of an individual. If a register of deeds is presented with an instrument that contains more than the last four characters of the Social Security number of an individual and if the register of deeds records the instrument but does not discover the error until after the instrument is recorded, the register of deeds may not be held liable for the instrument drafter’s placement of the Social Security number on the instrument and the register of deeds may remove or obscure enough of the Social Security number such that no more than the last four characters of the number are discernable on the instrument.  Also under this bill, if a register of deeds records an instrument that contains an entire Social Security number, the instrument drafter is liable to the individual whose Social Security number appears in the instrument for damages of not more than $5,000, plus actual damages.  The changes to current law made in the bill do not apply to federal tax liens.
