Specific Performance Definition

The actual accomplishment of a contract by the party bound to fulfill it. An equitable remedy to compel the precise or substantial performance of a contract. The right to the remedy was in its origin dependent on the inadequacy of the legal remedy by suit for damages, but this rule has been very much relaxed. 2 N. Y. 60; 7 111. 327.

The performance of a contract according to its exact terms. A court of equity (in U.S. law) will enforce specific performance, whereas a court of law awards damages to the injured party to a contract Specific performance is never enforced in contracts for personal services. It is usually confined to sales of real property (in U.S. law) and unique personal property, for example an antique.
