A discontinuance of cohabitation (in U.S. law) by mutual agreement of a husband and wife or by the decree (in U.S. law) of a court. In an action for separation, the complaining party must establish the existence of a valid marriage and then must prove the wrongdoing by the other party that constitutes grounds for separation. In New York State, an action for separation may be maintained by either spouse on the grounds of cruelty (in U.S. law), conduct making it unsafe to cohabit with the defendant; desertion (in U.S. law), or adultery (in U.S. law). Separation in the U.S. Code: Title 10, Subtitle E, Part II, Chapter 1221

The current, permanent, in-force federal laws regulating separation are compiled in the United States Code under Title 10, Subtitle E, Part II, Chapter 1221. It constitutes “prima facie” evidence of statutes relating to Army Reserve (including separation) of the United States. The reader can further narrow his/her legal research of the general topic (in this case, Army Reserve Personeel of the US Code, including separation) by chapter and subchapter.
