A contract (in U.S. law) between a husband and wife, who are not living together as such, that provides for the division of property, support, and the custody of children (in U.S. law). The agreement can be enforced in the same way as any other contract. To enter into a separation agreement, there does not have to be a separation (in U.S. law) action pending in court. A separation agreement will become void upon the resumption of cohabitation (in U.S. law) with the intent to reconcile or resume marital relationships.
