An arrangement whereby the employer is free to hire whomever he or she chooses, but all employees must join the union within a specified period. All employees must remain in good standing of the union where such an agreement exists. See closed shop (in U.S. law).

Concept of Open Shop in Labor Law

In this context, a definition of Open Shop is offered here: Where employees do not have to belong to the union or pay dues to secure or retain employment in a company, even though there may be a collective bargaining agreement. The Union is obligated by law to represent members and non-members equally regardless of whether it is an open shop or a union shop.
