Notice of Violation (NOV) in Environmental Law

A notice from the Environmental Protection Agency or a state agency to advise the recipient that the recipient has violated a statute, regulation, or the terms of a permit. NOVs also detail how a hearing or a meeting with the agency can be arranged. If the alleged violator does not contest the notice, it will be followed with a compliance order. The agency may also issue an administrative penalty order, forcing payment of a penalty for the violations.

The notice of violation often precedes a two-way communication that can benefit both the alleged violator and the agency. The recipient of the notice has the opportunity to discuss the reasons for the violation or demonstrate why the notice is in error. If the notice was correct and a violation did occur, the agency and the violator may be able to work out an agreement to eliminate the problems that caused the violation.
