Nolle Prosequi in the United States
A prosecutorial decision not to continue a criminal case. Nolle prosequi, often referred to as “nolle” or “nol pros,” is a formal entry on the record dismissing a charge against a defendant.

Significance The nolle prosequi is a key option for prosecutors as they exercise control over the charging process. Prosecutors must screen cases before they come into the process and determine whether there exists cause to charge. Prosecutors may initially seek charges only to later dismiss some of these cases through the nolle prosequi. Often dismissal of one charge produces a decision by a defendant to plead guilty to another. Thus, the nolle is important in the plea negotiating process. The pattern in the United States is that once charges are initiated against an accused, cases are statistically more likely to be terminated through the nolle than by actions of judges or juries. In some states, a court must agree to the prosecutor’s motion to dismiss.
