Mispleading Definition

Pleading incorrectly, or omitting anything in pleading which is essential to the support or defense of an action, is so called. 198 111. 466. Pleading “Not guilty” to an action of debt is an example of the first; setting out a defective title is an example of the second. See 3 Salk. 865. It comprehends misdeclaring, whether the error is in separate counts, or in the misjoining of counts. 22 Wend. (N. Y.) 869, 375.
