Practical Information

One who has obtained a judgment (in U.S. law) against a debtor. For example, when a seller wins a suit against a customer who has failed to pay debts, the seller is given a judgment against the debtor. The judgment officially declares that the debtor owes the seller the amount stated in the judgment, and that the seller shall recover that amount from the debtor. Frequently, however, a debtor refuses to pay a judgment or insists that he or she cannot pay it. The creditor can then instruct an attorney to apply to the court for an order, or WRIT, directing the sheriff to seize the debtor’s property. This is called applying for a writ (in U.S. law) of Execution. In some states an attorney can issue the writ without applying to the court. The property is sold and the creditor is paid out of the proceeds of the sale. Only property in the state where the suit is brought can be seized to satisfy the judgment. If the property is located out of the state, another suit, technically known as suit on the judgment, must be brought in that state.
