Issue Of Execution

Issue Of Execution in United States

Practical Information

Note: Some of this information was last updated in 1982

When a judgment is obtained by one party against another, the successful party is known as a judgment creditor and the other party as a judgment debtor. If the judgment debtor does not pay the judgment, the attorney for the judgment creditor may get the clerk of the court (in U.S. law) to issue execution to a designated officer of the law, usually the sheriff, constable, or Marshall. The execution is a printed form, easily filled out upon the basis of the information in the file. If the officer to whom the execution is issued can find no property of the judgment debtor against which to levy, the officer returns the execution
