Interlocutory Decree in United States

Practical Information

Note: Some of this information was last updated in 1982

An intermediate or preliminary finding of a court. It is not conclusive and does not determine the suit, but directs some further proceedings preparatory to the final decree (in U.S. law) . For example, in an action for partition (division of property among co owners), an interlocutory judgment must first declare what is the right, share, or interest of each party in the property. A final decree of partition is thereafter given based on the interlocutory finding. See also judgment (in U.S. law).
