A contract whereby one party agrees to secure another against an anticipated loss or damage, and the liability under which is coterminous with the liability it is intended to cover. 53 L. J. Q. An undertaking, either express or implied, to compensate another for loss or damage, or for expenses or trouble incurred, either in the past or in the future. Under a contract of indemnity, the indemnity is the obligation or duty resting upon a particular person or company to make good any loss or damage another has suffered, or may suffer, upon the happening of a specific event. The person giving the indemnity (agreeing to indemnify) is the indemnitor, corresponding to the insured. The term indemnify also applies to the sum paid as compensation or remuneration in the event of loss or damage to the indemnitee. The indemnity may be payable to the indemnitee or to someone else in behalf of the indemnitee. For example, the payments that are made to an injured workman under workmen’s compensation insurance are indemnities. They are payable to the worker in behalf of his or her employer, who is the indemnitee.

    Indemnity meaning

    Compensation given (often from an insurance fund) to make whole the injury already sustained. May refer either to compensation via private insurance, social insurance or indemnisation of the victim of a tort by the tortfeasor through whatever resources the tortfeasor has.
