Fiduciary Definition
This term is borrowed from the civil law. The Roman laws called a fiduciary heir the person who was instituted heir, and who was charged to deliver the succession to a person designated by the testament. Merlin, Repert. But Poth. ad Pand. vol. 22, says that fiduciarius haeres properly signifies the person to whom a testator has sold his inheritance under the condition that he should sell it to another. Fiduciary may be defined in trust, in confidence. A generic term embracing all persons acting in a fiduciary capacity.

A person or organization such as a corporation (in U.S. law) holding a position and acting in the capacity of trust and special confidence so that he, she, or it is obliged to act with the highest degree of good faith, and to place ahead of his, her, or its own interests the interest of those represented; as an adjective having the nature of a trust. Attorneys, guardians, directors of corporations, and public officers may be fiduciaries.

Meaning of Fiduciary
In plain or simple terms, Fiduciary means: A person who has assumed a special relationship to another person or another person’s property, such as a trustee, administrator, executor, lawyer, or guardian. The fiduciary must exercise the highest degree or care to maintain and preserve the person’s rights and/or property which are within his/her charge.
