Names (either imaginary or only partly accurate) that are used temporarily in preparing legal papers in an action, with the express intention that the true names be substituted as soon as they are learned. Since someone frequently has an interest that the plaintiff (see parties to an action (in U.S. law)) does not know about, or someone whose name is unknown has an interest in the suit, several fictitious names are added as defendants can be brought into the action without the necessity of serving an amended complaint on all defendants. Perhaps an interested party’s last name is known but not his first; a fictitious first name is given to that defendant thus: “Richard” Neilson, first name “Richard” being fictitious, defendant’s first name being unknown to the plaintiff. The complaint usually alleges that the names are fictitious. The true names are substituted as soon as they are learned. In all subsequent papers filed in the case, the caption reflects the substitution.
