Definition of Fair Market Value (in Charity Law)
A concept of Fair Market Value in the context of charitable ogranizations applicable in the United States is provided here: The IRS defines fair market value as “the price that would be agreed on between a willing buyer and a willing seller, with neither being required to act, and both having reasonable knowledge of the relevant facts.” If there is a restriction on the use of the property (such as a conservation easement), “the fair market value price must reflect that restriction.” (IRS publication 561, Determining the Value of Donated Property.)
