Executive Order in Environmental Law

A directive issued by the president to executive agencies and published in the Federal Register after it is signed. Executive orders reflect the philosophy of the president toward agency structure and the regulatory process; they also set priorities and give the agencies direction. Since most federal agencies are within the executive branch, executive orders exert a great deal of influence on regulatory action.

The most infamous of the executive orders that impacted the Environmental Protection Agency was Executive Order 12291, issued by Ronald Reagan on 17 February 1981. The order anticipated his strategy of making regulations more difficult to promulgate: it prohibited regulatory action unless the potential benefits of the action exceeded the potential costs.

After Executive Order 12291, every proposed regulation had to be scrutinized by the Office of Management and Budget (OMB), and what had been merely one consideration in the rulemaking process became a crucial element. The OMB review focused on figures. Since the price tag associated with environmental benefits is hard to calculate, many regulations were effectively killed because of the review process.

Executive Order in the Context of Law Research

The Thurgood Marshall School of Law Library defined briefly Executive Order as: An order issued by the President under specific authority granted to the President by Congress. There is no precise distinction between a presidential proclamation and an executive order; however, a proclamation generally cover matters of widespread interest, and an executive order often relates to the conduct of government business or to organization of the executive department. Every act of the President authorizing or directing the performance of an act, in its general context, is an executive order.
