Exceptio Rei Judicatae Definition
(Lat.) In the civil law. An exception or plea of matter adjudged; a pleathat the subject matter of the action had been determined in a previous action. Inst. 4. 13. 5; Dig. 44. 2. This term is adopted by Bracton, and is constantly used in modern law to denote a defense founded upon a previous adjudication of the same matter. Bracton, fols. 100b, 177; 2 Kent, Comm. 120. A plea of a former recovery or judgment.
