Customs Definition

This term is usually applied to those taxes which are payable upon goods and merchandise imported or exported. Story, Const. § 949; Bac. Abr. Smuggling. The duties, toll, tribute, or tariff payable upon merchandise exported or imported. These are called customs from having been paid from time immemorial. Expressed in law Latin by custuma, as distinguished from consuetudines, which are usages merely. 1 Sharswood, Bl. Comm. 314.

The government agency concerned with collecting duties and enforcing the rules and regulations that govern the export and import of merchandise. The United States Customs Service is under the jurisdiction of the Treasury Department; it maintains staffs in all American ports of entry and has representatives in many important foreign ports. imported goods must be “entered” upon arrival with customs officials either by the importer or his authorized agent, the broker, regardless of whether the goods are dutiable or duty free.
