Consent Decree Definition

A decree based upon the consent or agreement of the parties, which may supersede both pleading and evidence and even go to the length of pointing out and limiting the relief to be granted. 253 111. 491. A consent degree is not, in a strict legal sense ‘a judicial sentence,’ but it is in the nature of a solemn contract and which cannot be amended or in any way varied, without the like consent, or reheard in the court that rendered it, appealed from, or reversed upon a writ of error or bill for review 120 111. App. 645; 174 111. 154.

Concept of Consent Decree in Labor Law

In this context, a definition of Consent Decree is offered here: An order of a court or agency which is entered into by agreement of all parties. In 1989 the General Executive Board of the IBT signed a consent decree which provided for rank and file elections of International Teamsters officers. This consent decree also established an Independent Review Board with the power to investigate and penalize officials judged to be corrupt.
