Certification in the United States
A request to a higher court by a lower court for guidance on a legal question relating to a pending case. Request for certification in the federal courts can come from either the U.S. court of appeals or the U.S. district court. The U.S. court of claims may also initiate such a request. This process allows lower courts to obtain clarification of key legal questions. Provisions of state law typically allow certification of questions within state courts. When the U.S. Supreme Court receives a certified question, it may offer specific instructions to the lower court. These instructions are binding. Otherwise, the Court may request forwarding of the entire record and make final judgment on the matter itself.

Analysis and Relevance
Certification is a method by which the U.S. Supreme Court or state courts of last resort may review legal questions. This method of review differs from appeal or certiorari in that it is not initiated by the parties to a dispute but by the court having jurisdiction over the case. Because certification is a departure from usual procedures, it is seldom used.
