Caption Definition

(1) A taking, or seizing; an arrest. The word is no longer used in this sense.
(2) The heading of a legal instrument in which is shown when, where, and by what authority it was taken, found, or executed. Principally used in respect to indictments. See, as to requisites, 8 Gray (Mass.) 454; 1 South. (N. J.) 46. This meaning, now the general one, is not justified by the derivation, which is from capere, to take, and not from caput, a head. In the English practice, when an inferior court, in obedience to the writ of certiorari, returns an indictment into the king’s bench, it is annexed to the caption, then called a schedule, and the caption concludes with stating that it is presented in manner and form as appears in a certain indictment thereto annexed, and the caption and indictment are returned on separate parchments. 1 Wm. Saund. 309, note 2.

Caption of Legal Document or Court Paper

The heading that is written on a legal document or court paper. The caption consists of the following parts: (a) Jurisdiction and venue. Usually the jurisdiction, that is, the name of the court in which the case is brought, and the venue are recited together in In a few states the venue is recited separately from the jurisdiction, (b) Title of the case. This gives the names and designations of the various parties to the action. The heading that appears on the summons and complaint is used throughout the action until it is appealed, unless (1) there should be a change of parties by amendment, or (2) there is more than one plaintiff or defendant. In the latter case, it is necessary to show only the first named plaintiff and the first named defendant, followed by appropriate words indicating that there are others, such as et al., et ux., et vir. (c) Index number. The index, docket, or action number is assigned by the clerk of the court (in U.S. law).

Caption of Abstract

An abstract of title, as i: relates to real estate, will normally begin with the caption sheet. The caption sheet generally shows the exact description of the property covered by the abstract. As the lands covered by the abstract are increased or decreased, the caption of the abstract will be changed. It is common practice, when this is done, to change the caption sheet of the abstract. However, in some areas, a new caption sheet will be entered inside the body of the abstract, and the abstractor may or may not note on the original caption sheet that a new caption has been inserted. When an attorney is examining the abstract, the attorney will find the new caption sheet and will alert all parties dealing with the title to the land that the description of land is to be taken from the new caption sheet and will generally refer to the page number of the abstract where the new caption sheet is located.

Caption of Case on Appeal

The part of a motion (see motion (in U.S. law)) or brief (see more here) that gives the name of the parties (see parties (in U.S. law) to an Appeal) and the name of the apellate court (in U.S. law) where the appeal (in U.S. law) is being made. When the record on appeal (in U.S. law) is filed with the appellate court, the caption has changed from what is was in the lower court. The new caption indicates the name of the appellate court, and the designation of the parties show their appellate status. The lower court’s index number (see clerk of the court (in U.S. law)) of the case is no longer indicated.
