Practical Information

Note: Some of this information was last updated in 1982

Within a certain number of days after the notice (in U.S. law) of Appeal is filed, the number being specified by the rules of the reviewing court (see appeal (in U.S. law)), the appellant files assignments of error and directions to the clerk of the court (in U.S. law) for making up the transcript of record on appeal. The assignments of error and directions to the clerk may be combined in one document.

The purposes of the assignment of errors are to apprise the appellate court of the specific questions presented by the appellant for consideration and to inform the opposite party of the matters of error relied on, so discussion may be limited and concentrated on those points.

The directions to the clerk designate the portion of the proceedings and evidence to be included in the transcript of record those portions pertinent to the questions before the appellate court. The appellee might consider that other portions of the record will throw light on the questions to be reviewed by the court. If so, the appellee files additional directions and cross assignments.

In lieu of directions to the clerk, the parties may file written stipulations with the clerk designating the contents of the record.
