An affidavit (in U.S. law) executed by the seller upon sale of real property (in U.S. law) to assure the purchaser that there are no defects in the seller’s title (in U.S. law) to the property. The affidavit of title supplements a title examination; it covers matters that may not be revealed by a title search (in U.S. law) . It furnishes additional protection to the purchaser, for a false affidavit of title may subject the seller to criminal prosecution. The affidavit of title also serves as a means of identifying the person executing the papers to be delivered on closing title (in U.S. law) to the satisfaction of the title company that insures the title.
